1 Plaintiff Erwin appeals from the trial courts order granting summary judgment to the defendant in this action for attorney malpractice. The Court of Appeals affirmed the trial courts order, and we have granted certiorari. Because we find that the presence of material fact issues precludes summary judgment in this case we vacate the opinion of the Court of Appeals, reverse the order of the trial court, and remand for further proceedings below.
